Please read these Terms of Service (“Terms”) carefully before using the Rent the Scene website, mobile application, or any related services (collectively, the “Services”). These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Rent the Scene (“Company,” “we,” “us,” or “our”).

By accessing or using our Services — whether online, through our app, or in person — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of our Services immediately.

1. ELIGIBILITY & ACCOUNT REGISTRATION

To use our Services, you must:

• Be at least 18 years of age

• Have the legal capacity to enter into a binding contract

• Not be barred from receiving services under applicable law

If you create an account with us, you agree to:

• Provide accurate, current, and complete information during registration

• Maintain and promptly update your account information as needed

• Notify us at info@rentthescene.com of any updates/changes of your account information

You are solely responsible for all activity that occurs under your account. Rent the Scene reserves the right to suspend or terminate services that contain false information or that are used in violation of these Terms.

2. PERMITTED USE OF SERVICES

Our Services are provided for the purpose of renting event/party equipment for lawful personal and commercial events. You agree to use the Services only for their intended purpose and in compliance with all applicable laws and regulations.

You may NOT use our Services to:

• Engage in any unlawful, fraudulent, or deceptive activity

• Sublease, re-rent, or transfer rented equipment to any third party without written consent from Rent the Scene

• Use rented equipment outside the scope of the agreed rental period or event

• Tamper with, modify, or attempt to repair any rented equipment

• Use equipment in a manner that poses a safety risk to persons or property

• Misrepresent your identity, event details, or intended use of equipment

• Interfere with, disrupt, or attempt to gain unauthorized access to our website, servers, or databases

• Scrape, harvest, or collect data from our website using automated tools

• Post or transmit any content that is defamatory, obscene, threatening, or otherwise objectionable

3. RENTALS, ORDERS & PRICING

a) Rental Bookings

All rentals are subject to equipment availability and must be confirmed by Rent the Scene in writing (via email or signed contract). A booking is not confirmed until you receive written confirmation from us and the required 25% deposit has been received.

b) Pricing & Fees

All prices listed on our website or quoted by our team are in U.S. dollars and are subject to change without notice. Final pricing will be confirmed in your rental contract and may include:

• Equipment rental fees

• Delivery and pickup fees

• Setup and teardown fees

• Security deposits (refundable, subject to equipment condition)

• Applicable taxes and processing fees

c) Payment

A non-refundable deposit is required to secure your booking. Full payment terms are outlined in your individual Rental Agreement. Rent the Scene accepts payment via credit/debit card, check, cash, or bank transfer. A 3% processing fee applies to all card transactions.

d) Cancellations & Refunds

Cancellations are subject to the cancellation policy outlined in your signed Rental Agreement. Deposits are non-refundable. Refunds, if applicable, will be issued to the original payment method within 10 business days.

4. EQUIPMENT USE & RESPONSIBILITY

By renting equipment from Rent the Scene, you agree to:

• Inspect all equipment upon delivery and report any pre-existing damage or defects within 2 hours of receipt

• Use all equipment only for its intended purpose and in a safe, appropriate manner

• Protect equipment from weather, theft, vandalism, and misuse during the rental period

• Return all equipment at the agreed time, in the same condition as received, clean and properly assembled or disassembled as instructed

You are fully responsible for any damage, loss, or theft of rented equipment during the rental period. Rent the Scene reserves the right to charge your payment method on file for repair or replacement costs beyond normal wear and tear.

5. INTELLECTUAL PROPERTY

All content on the Rent the Scene website and app — including but not limited to text, graphics, logos, images, photographs, video, audio, and software — is the exclusive property of Rent the Scene or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our website and Services for personal, non-commercial purposes. You may not:

• Copy, reproduce, distribute, or republish any content from our website without prior written permission

• Modify or create derivative works based on our content

• Use our trademarks, logos, or brand assets without express written authorization

• Remove any copyright, trademark, or proprietary notices from our materials

6. USER-GENERATED CONTENT

If you submit reviews, photos, testimonials, feedback, or any other content to Rent the Scene (“User Content”), you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, display, reproduce, modify, and distribute that content in connection with our Services and marketing activities.

You represent and warrant that you own or have the necessary rights to the User Content you submit, and that it does not violate any third-party rights or applicable laws. Rent the Scene reserves the right to remove any User Content at its discretion without notice.

7. THIRD-PARTY LINKS & SERVICES

Our website may contain links to third-party websites, platforms, or services for your convenience. These links do not imply endorsement by Rent the Scene. We have no control over third-party content or practices and are not responsible for any loss or damage that may arise from your use of third-party services.

We encourage you to review the terms and privacy policies of any third-party sites you visit.

8. DISCLAIMERS & LIMITATION OF LIABILITY

a) “As Is” Disclaimer

THE SERVICES AND ALL RENTED EQUIPMENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. RENT THE SCENE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

b) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RENT THE SCENE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES OR RENTED EQUIPMENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall our total liability to you exceed the total amount you paid to Rent the Scene in the 12 months preceding the claim.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Rent the Scene and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising out of or relating to:

• Your use or misuse of the Services or rented equipment

• Your violation of these Terms

• Your violation of any third-party rights, including intellectual property or privacy rights

• Any event, injury, or damage caused at your event venue involving rented equipment

10. TERMINATION OF ACCESS

Rent the Scene reserves the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms

• Suspected fraudulent, abusive, or illegal activity

• Non-payment or repeated late payments

• Damage to or loss of rented equipment

Upon termination, any outstanding balances remain due and payable immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, indemnification, and governing law) shall continue to apply.

11. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions.

Informal Resolution

Before initiating any formal proceeding, you agree to contact us at info@rentthescene.com and attempt to resolve the dispute informally. We will make reasonable efforts to resolve the matter within 30 days.

Binding Arbitration

If informal resolution fails, any dispute arising from or relating to these Terms or the Services shall be resolved through binding arbitration in Greenville, South Carolina under the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action lawsuit.

Exceptions

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

12. MODIFICATIONS TO TERMS

Rent the Scene reserves the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this document and post a notice on our website. For registered users, we may also send an email notification.

Your continued use of our Services after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using our Services.

13. GENERAL PROVISIONS

• Entire Agreement: These Terms, together with our Privacy Policy and any signed Rental Agreement, constitute the entire agreement between you and Rent the Scene regarding your use of our Services.

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

• Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.

• Notices: All legal notices to Rent the Scene must be sent in writing to 3210 N. Pleasantburg Dr. Greenville, SC 29609 PMB# 1005 or info@rentthescene.com.

• Force Majeure: Rent the Scene shall not be liable for any delay or failure in performance due to circumstances beyond our reasonable control, including natural disasters, power outages, government actions, or pandemic-related disruptions.
